KivoPlay does NOT host, upload, store, or stream any media files, videos, or copyrighted material on its own servers.

KivoPlay acts purely as an automated search engine and indexing tool, aggregating metadata and providing hyperlinks to third-party file-hosting providers (e.g., Google Drive, DropBox, various CDNs). We have no control over the content, servers, or networks of these third-party services. By using KivoPlay, you acknowledge that we function similarly to standard search engines (like Google or Bing) and fall under the "Safe Harbor" provisions of the Digital Millennium Copyright Act (DMCA) and Article 14 of the EU e-Commerce Directive ("mere conduit" / caching / hosting exception).

2. DMCA Takedown Process

While we do not host the files, we respect intellectual property rights and voluntarily comply with DMCA link-removal requests. If you wish to have a hyperlink removed from our index, you must submit a formal DMCA takedown notice containing all of the following:

1. Identification of the copyrighted work: Provide a detailed description of the copyrighted work claimed to have been infringed.
2. Identification of the material to be removed: Provide the exact, specific URL(s) on KivoPlay that contain the hyperlink to the infringing material. General site URLs or search queries are invalid.
3. Contact Information: Your full legal name, physical address, telephone number, and official email address (free email providers like Gmail/Yahoo may be rejected for verification purposes).
4. Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Signature: A physical or electronic signature of the copyright owner or authorized agent.

4. Abuse of the DMCA Process

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. We reserve the right to seek damages (including costs and attorneys' fees) from anyone who submits a fraudulent takedown notice.

5. Counter-Notification

If you believe a link was removed as a result of mistake or misidentification, you may submit a Counter-Notification containing your name, address, phone number, a statement under penalty of perjury that the removal was a mistake, and your consent to the jurisdiction of the federal courts.
